Terms of Service

01The agreement

These terms are a contract between you and hfs2s, operated by Les from Spain ("we", "us"). By creating an account or using the service you accept them. If you do not, do not use hfs2s.

Three documents, one agreement. The privacy policy is part of this deal, not separate from it.

The privacy policy and the cookie policy form part of these terms.

02Who may use hfs2s

You must be at least 18 and able to enter a binding contract. If you are using hfs2s for an organisation, you confirm you are authorised to accept these terms on its behalf, and "you" means that organisation.

Access is by approval. Signing up puts you on a waiting list; it does not entitle you to an account. We may decline or withdraw access at our discretion, and during a private beta we will sometimes do so simply because we are at capacity.

03Your account

  • Give us an email address you actually control. It is how you sign in.
  • Keep access to that address secure. Sign-in links sent to it will sign somebody in — anyone who reads your email can become you here.
  • Do not share your account or let someone else use it.
  • One workspace per account, unless we have agreed otherwise with you.
  • Tell us at [email protected] if you think someone else has got in.

Your email inbox is the key to this account. Treat it that way.

04What we provide

An approved account gets:

  • A private workspace — an isolated environment with persistent storage for your app and its history.
  • An AI agent in that workspace that builds and changes your app from what you type in the chat.
  • Hosting for the app it builds, served at hfs2s.app/app/<id>/.
  • Version history, so you can save a version and go back to it.
  • A human engineer paired with you, to the extent we have said so.

We may change, add or remove features. During the beta this happens often, and we will not always announce it in advance.

05It is a beta

Set your expectations here

hfs2s is an early beta. There is no uptime guarantee, no support SLA, no redundancy, and no backup you can restore from. Things will break, and some breakages will lose work.

Keep your own copy of anything that matters. Your app is a git repository and you can take it away at any time. Do that regularly.

Not a disclaimer for the sake of it — please keep your own copy.

The service is currently free. If we introduce charges, we will tell you before they apply to you and you will be free to leave instead.

06What you own

You own what you build. The brief you write, the files you upload, the messages you send and the source code produced in your workspace are yours. We claim no ownership of any of it.

You own it, we host it. That is the entire arrangement.

You grant us a licence to host, store, copy and process that content strictly so we can run the service for you — hold it in your workspace, pass it to the AI model that acts on it, serve your app to visitors, and keep its version history. The licence is non-exclusive, worldwide and royalty-free because that is what hosting requires, and it ends when you delete the content or your account.

We will not use your content to train AI models. We will not show it to other customers. We will not publish it or use it in marketing without asking you first.

You are responsible for having the right to upload what you upload. Do not put someone else's copyrighted material, confidential information or personal data into your workspace unless you are entitled to.

Our own materials — the platform, the site, the name, the scaffold your app starts from — remain ours. The starter scaffold is yours to use, modify and deploy as part of your app.

07Working with an AI agent

Your app is written by an AI model. That has consequences you are accepting:

  • It can be wrong. Generated code may contain bugs, security flaws or logic that does not match what you asked for. Review anything before you rely on it, and get it professionally reviewed before it handles money, health data or anything else that hurts when it fails.
  • Output is not unique. A model given a similar brief may produce similar code for someone else. We make no claim that what it writes is original or that it can be protected.
  • Your input leaves our systems. Chat messages, briefs, uploads and code are sent to third-party AI providers outside the EEA. The privacy policy names them. Do not put anything in your workspace you are not free to disclose to them.
  • It acts on what you say. The agent works inside your workspace with broad permission to change files. If you tell it to delete something, it will.

Ask it to build you a shop, not a bank. And read what it wrote before you trust it.

You are responsible for the app you ship and for it complying with the law — including data protection law, if your app collects personal data from its own users. In that case you are the controller for that data and we are not.

08Your app is public

Apps are served at hfs2s.app/app/<id>/ and that address is deliberately shareable. It is not listed or indexed and the id cannot be guessed, but it is not password-protected: anyone with the link can open your app.

Sharing the link is the feature. Just know that it is a link, not a lock.

Your workspace, your chat and your files are private to you. Only the running app is public. Do not put anything into the app itself that you would not put on a public web page.

09Acceptable use

Do not use hfs2s to build, host, store or distribute:

  • Anything illegal under Spanish or EU law, or unlawful where your users are.
  • Malware, ransomware, phishing pages, credential harvesters or command-and-control infrastructure.
  • Material that sexually exploits children, incites violence or hatred, or harasses a person.
  • Spam, bulk unsolicited email, or anything designed to defeat another service's abuse controls.
  • Content that infringes someone else's intellectual property or privacy.
  • Deliberate impersonation of a real person or organisation, or fabricated records presented as genuine.

And do not:

  • Attack, probe or attempt to break out of your workspace, or try to reach another customer's workspace or any of our systems.
  • Reverse-engineer or circumvent our access controls, or use an account you were not given.
  • Mine cryptocurrency, run proxies or VPN exit nodes, seed torrents, or use your workspace as general-purpose compute unrelated to building your app.
  • Resell, sublicense or offer the workspace to third parties as a service of your own.
  • Use the AI agent to generate the material listed above, or to attack a third party.

Short version: build your thing, don't attack the box, don't make it a crime scene.

Security research is welcome if it stays inside your own workspace and is reported to [email protected]. We will not pursue you for a vulnerability found in good faith and not exploited. Testing against other customers' workspaces or our infrastructure is not covered by that.

10Fair use of shared capacity

Workspaces share capacity with everyone else's, and each has its own resource limits. A workspace left inactive for a while is put to sleep to free that capacity up — nothing is deleted and it wakes in a few seconds when you return.

If a workspace is consuming resources in a way that degrades the service for others, we may throttle it, sleep it, or ask you to stop. We will try to talk to you first.

11Suspension and termination

You can leave at any time. Ask at [email protected] and we will delete your account and your workspace. Take a copy of your app first — deletion destroys your workspace and its storage, including your code, its history, your files and your chat transcript, and there is no backup.

Export before you go. We cannot get it back for you afterwards.

We can suspend or close an account that breaches these terms, that puts the service or other customers at risk, or where the law requires it. For anything short of serious or illegal misuse we will contact you first and give you a chance to put it right. For serious or illegal misuse we may act immediately.

We may also end the beta, or the service, at any time. If we do, we will give you reasonable notice and a chance to export your work.

Sections 06, 12, 13 and 15 survive termination.

12No warranty

The service is provided "as is" and "as available". To the fullest extent the law allows, we make no warranties of any kind — express or implied — about merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted, secure, error-free, or that the code the agent writes will be correct, secure or suitable for anything.

This is a free private beta. Nothing on our marketing pages is a warranty.

13Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss; loss of profit, revenue, business, goodwill or anticipated savings; or loss or corruption of data or code — which is precisely why section 05 asks you to keep your own copy.

The service is free, so our exposure is capped at what you paid: nothing, or €100 if you did pay.

Our total aggregate liability arising out of or relating to these terms is limited to the greater of the amount you paid us in the twelve months before the claim, or €100.

Nothing here limits liability that cannot be limited by law — including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for gross negligence or wilful misconduct.

If you use hfs2s in the course of a business, you agree to indemnify us against claims brought by a third party arising from the app you built, the content you put into it, or your breach of these terms.

14If you are a consumer

If you use hfs2s as a consumer rather than for a business, you keep every right Spanish and EU consumer law gives you, and nothing in these terms takes those away. Where a clause above conflicts with a mandatory consumer protection, the protection wins and the rest of the clause stands.

The EU's Online Dispute Resolution platform is available at ec.europa.eu/consumers/odr, though we would much rather you emailed us first.

15Law and disputes

These terms are governed by the laws of Spain. Disputes go to the courts of Spain. If you are a consumer, this does not deprive you of the protection of the mandatory law of the country where you live, or of your right to bring proceedings in your local courts.

If any part of these terms is found unenforceable, the rest stays in force. Not enforcing something once does not waive it. You may not transfer your rights under these terms without our consent; we may transfer ours if the service changes hands, and will tell you if that happens.

These terms, with the privacy and cookie policies, are the whole agreement between us about the service.

16Changes

We will update these terms as the product changes. The effective date and version at the top say which text you are reading. For material changes we will email you and give you reasonable notice; continuing to use hfs2s after that means you accept the new version. If you do not, close your account.

Anything unclear here, ask: [email protected]. If a clause on this page does not make sense to you, that is a fault in our writing, not in your reading.
